Attualmente le parti di ricambio per vetture francesi non possono essere vendute in Francia.

Il loro utilizzo, così come quello dei riferimenti originali, serve unicamente per aiutare ad identificare il modello d’auto sul quale deve essere montato il pezzo di ricambio.
I nostri articoli, pur non essendo originali, sono perfettamente adattabili alle auto a cui si riferiscono.

Unsere Artikel sind keine Originalteile, jedoch sind sie an den entsprechenden Autos völlig anpassbar.

  MERCATO FRANCESE

I ricambi di qualità equivalente destinati ad essere montati su vetture francesi come CITROEN, PEUGEOT, RENAULT e visibili durante il normale utilizzo del veicolo, prodotti e distribuiti da ISAM S.p.A, non possono essere venduti e/o rivenduti, direttamente dal cliente, da suoi preposti e/o clienti nonché da terzi, in Francia ed in tutti i paesi in cui risulta vigente la legge francese in materia di proprietà industriale ed intellettuale.

Ai sensi della sentenza della corte di giustizia UE del 26/09/2000, il semplice transito di tali prodotti – legalmente fabbricati in uno stato membro UE per essere commercializzati, parimenti in modo lecito, in un altro stato membro UE – in territorio francese e/o in altro in cui risulta vigente la legge Francese in materia di proprietà industriale ed intellettuale, non lede il diritto del titolare di un marchio, disegno o modello poiché tale fatto non implica alcuna utilizzazione illecita del diritto protetto, in quanto il transito intracomunitario non rientra nell’oggetto specifico del diritto di proprietà industriale e commerciale sui marchi, disegni o modelli.

  FRENCH MARKET

The matching quality spare parts to be fitted on French cars such as CITROEN, PEUGEOT, RENAULT and visible during the normal use of the vehicle, produced and/or distributed by ISAM S.p.A, cannot be sold and/or resold directly by the customer, by persons in charge and/or customers as well as by third parties, in France and all over the countries where the French regulation on industrial and intellectual property is applicable.

According to the sentence of the EU court of justice dtd. 26/09/2000, the mere transit of such products – legally manufactured in a member state of the European union to be legitimately sold in another EU member state through the French territory and/or through the countries where the French intellectual and industrial property regulation is applicable, doesn’t affect the right of the proprietor of a trade mark, design or model, as this action doesn’t mean an illegal use of the right of protection. Infact the intra-community transit is not a specific subject of the industrial and commercial property right on trademarks, designs or models.

  MARCHÉ FRANÇAIS

Les pièces de rechange de qualité équivalente à l’origine qui vont être montées sur les voitures françaises tels que CITROEN, PEUGEOT, RENAULT et qui sont visibles pendant l’utilisation normale d’un véhicule, produites et/ou distribuées par ISAM S.p.A, ne peuvent pas être vendues et/ou revendues directement par le client, ses mandatés et/ou clients ainsi que par des tiers, en France et dans d’autres pays où le droit de propriété intellectuelle et industrielle français est applicable.

Au sens de la décision de la Cour de justice UE du 26/09/2000, le simple transit de ces produits – légalement fabriqués dans un état membre UE pour être commercialisées licitement dans un autre pays membre UE – sur le territoire Français et/ou sur autres territoires où le droit de propriété intellectuelle et industrielle Français est applicable, ne porte pas atteinte au droit du titulaire d’une marque, dessin ou modèle, car ce fait n’implique pas aucune utilisation illicite du droit de protection. En effet, le transit intracommunautaire n’entre pas dans l’objet spécifique du droit de propriété industrielle et commerciale sur marques, dessins et modèles.

ISAM PRODUCE RICAMBI DI QUALITÀ EQUIVALENTE IN CONFORMITÀ ALLA DEFINIZIONE CONTENUTA NEL CONSIDERANDO N. 20 DELLE LINEE GUIDA AL REGOLAMENTO UE N. 461/2010, COME DIMOSTRATO DALLE NOSTRE CERTIFICAZIONI E DALLE CERTIFICAZIONI TÜV.

Nel passato, il ricambio originale (ossia, per semplificazione, quello prodotto direttamente dal costruttore del veicolo ovvero dai fornitori di primo equipaggiamento, secondo le specifiche tecniche e gli standards di produzione forniti dalla casa auto per la produzione di componenti utilizzati per l’assemblaggio dei suoi veicoli) è sempre stato inteso come avente un grado di qualità superiore rispetto a quello proveniente dai produttori non originali.

Con l’avvento del Regolamento CE di esenzione per categoria, n. 1400/2002 (anche conosciuto come Legge Monti), relativo all’applicazione dell’art. 81, paragrafo 3, del trattato CE (ora sostituito dall’art. 101, paragrafo 3 del trattato sul funzionamento dell’Unione Europea) a categorie di accordi verticali e pratiche concordate nel settore automobilistico, grazie alla definizione contenuta nell’art. 1, comma 1, lett. u, veniva introdotto il concetto di “pezzi di ricambio di qualità corrispondente” da intendersi come quei pezzi di ricambio fabbricati da qualsiasi impresa che possa certificare, in qualunque momento, che la qualità di detti pezzi di ricambio corrisponde a quella dei componenti che sono stati usati per l’assemblaggio degli autoveicoli in questione.

Successivamente, a seguito della scadenza del Regolamento n. 1400/2002 prevista per il 31 maggio 2010, la Commissione Europea ha introdotto un nuovo quadro normativo per il settore automobilistico, focalizzato sui problemi dell’aftermarket.

Applicate nel mercato a partire dal 1 giugno 2010, queste nuove regole sono contenute nel Regolamento di esenzione (UE) n. 461/2010 e relative Linee Guida (specifiche per il settore sulle restrizioni verticali degli accordi per la vendita, la riparazione dei veicoli e la distribuzione dei ricambi) nonché nel Regolamento di esenzione (UE) n. 330/2010 e relative Linee Guida sugli accordi verticali.

Tali norme, le quali troveranno applicazione fino al 31 maggio 2023, riguardano la produzione e il commercio dei pezzi di ricambio così come l’attività di riparazione e di manutenzione di automobili, veicoli commerciali leggeri ed autocarri).

Nel considerando n. 20 delle Linee Guida al regolamento n. 461/2010, è contenuta la nuova definizione di “ricambi di qualità equivalente” in base alla quale sono tali i pezzi di ricambio dotati di qualità sufficientemente elevata, in modo tale che il loro utilizzo non comprometta la reputazione della reti autorizzate dei costruttori di autoveicoli.

La responsabilità di provare che il pezzo di ricambio non soddisfa tale condizione ricade, sempre, sulla casa automobilistica.

Pertanto, in conseguenza di tale nuova definizione e a modifica della precedente contenuta nella Legge Monti, un ricambio di qualità equivalente non può, di per sé, fare riferimento alla qualità del pezzo montato in origine, anche se nulla toglie che lo stesso ricambio di qualità equivalente possa avere una qualità anche maggiore di quello originale.

ISAM PRODUCES MATCHING QUALITY SPARE PARTS ACCORDING TO THE DEFINITION CONTAINED UNDER COVER OF PARAGRAPH 20 OF THE GUIDELINES TO 461/2010 EU REGULATION AS SHOWN BY OUR CERTIFICATIONS AND THE CERTIFICATIONS ISSUED BY TÜV.

In the past the original spare part ( in other words the spare directly produced by the vehicle’s Home Manufacturer and/or by their suppliers following to the standards and the technical specifications supplied them by the vehicle’s Home Manufacturer itself, utilized for the production of the components to be assembled to the vehicles) has always been understood as a higher quality product if compared to the one produced by equivalent manufacturers.

Following to the coming into force of the EC regulation 1400/2002 ( known as ” Monti’s Law) relating to the enforcement of the clause 81 paragraph 3 of EC treaty ( at present replaced by the clause 101, paragraph 3 of the operation treaty of the EC) of bloc exemption to categories which operate in the automotive filed having vertical agreements and previously agreed practices, thanks to the definition quoted in the clause 1, paragraph 1, point u, it has been introduced the concept of “equivalent quality spare parts”, on other words, spare parts manufactured by any manufacturer anytime able to certify that the quality of the above mentioned parts is fully correspondent to the one of the components utilized to be assembled on a brand new car.

Then, due to the expiry of EC regulation 1400/2002 on 31/05/2010, the European Commission has introduced a new legislative framework for the automotive field , focused on aftermarket matters.

In force starting from 01/06/2010, these new standards are enclosed inside the bloc exemption Regulation (EC) 461/2010 and the relating guidelines ( sector- specific, about the vertical restrictions for the sale, the repair of the vehicles and the distribution of the spare parts) and inside the bloc exemption Regulation (EC) 330/2010 and relating guidelines on vertical agreements.

The above mentioned standards, applicable up to 31/05/2023, are referred to manufacturing and marketing of the spare parts, maintenance and repair of passenger cars, light duty vehicles and trucks.

Paragraph 20 of the guidelines to 461/2010 Regulation contains a new definition of “spares of equivalent quality” whereby such parts are spare parts having a quality level high enough to grant not to compromise the reputation of the producers of original parts authorized by the vehicle’s Home Manufacturers.

The liability to prove that a part is not able to satisfy this condition is, always, at vehicle’s Home Manufacturer charge.

Therefore, view this new definition modifying the previous one specified under cover of the Monti’s Law, an equivalent quality part cannot, by itself, refer to the quality of the part fitted to the origin, even if it will be possible that this equivalent spare may have a quality better than the original one.
