design\/ model of which ISAM is not the holder.<\/strong><\/p>\n<p>In the automotive field, the home manufacturers could have a a sort of \u201cproduct monopole\u201d on the components (body parts) protected by a design\/ model.<\/p>\n<p>The <strong>REPAIRS CLAUSE<\/strong> is a legal provision referred to the so- called \u201cvisible spares\u201d (body parts) which allows, under certain conditions, the production and sale of products (body parts) otherwise protected by a design\/ model for the only aim of repair\/ restore of the original appearance of the vehicle.<\/p>\n<p>Particularly relevant in the automotive industry context, the repairs clause is a legal instrument that limits the exclusive rights of the holders of the designs\/ models, allowing the independent operators to produce in replica and sell the spares <strong>with the only aim to repair\/ restore the original appearance of the complex product.<\/strong><\/p>\n<p>As provided from the 2823\/2024 Directive and the EU Regulation 2822\/2024 dtd. 23\/10\/2024:<\/p>\n<ul>\n<li>The repairs clause is only applicable on the parts\/ pieces whose shape and appearance are determined by the product as a whole (body parts generically understood)<\/li>\n<li>To be able to rely on the repairs clause, the independent producers\/ sellers must fulfill specific duties of care, specifically duly informing the users about the trade origin and the identity of the manufacturer of the product, to be utilized only for the repair of the vehicle and the restore of its original appearance.<\/li>\n<\/ul>\n<p>Referring to the above and regardless the way and the method of introduction adopted, <strong>ISAM RECOMMENDS THEIR CUSTOMERS AND DISTRIBUTORS TO INTRODUCE THE PRODUCTS ON THEIR MARKET CLEARLY STATING THE CUSTOMERS THE FEATURES AND SPECIFICATIONS MENTIONED ABOVE, WITH PARTICULAR ATTENTION TO THE IDENTITY OF THE MANUFACTURER AND THE MATTER THAT THEIR USE CAN\u2019T BE DIFFERENT FROM THE AIM TO REPAIR\/ RESTORE THE ORIGINAL APPEARANCE OF THE VEHICLE. <\/strong><\/p>\n<p><strong>ISAM INFORM THAT ALL THE SUPPLIERS AGREEMENTS SIGNED WITH THEIR CUSTOMERS ARE SUBJECT TO In fact, the intra-community transit is not a specific subject of the industrial and commercial property right on trademarks, design or models.<\/p>\n<h2><img decoding=\"async\" class=\"alignnone size-full wp-image-31965\" src=\"https:\/\/isam.it\/wp-content\/uploads\/fr.png\" alt=\"\" width=\"40\" height=\"20\" \/>\u00a0 <span style=\"color: #ed3201;\">MARCH\u00c9 FRAN\u00c7AIS<\/span><\/h2>\n<p>Au sens de la sentence de la Cour de justice de l&#8217;UE du 26\/09\/2000, le simple <strong>transit<\/strong> de ces produits &#8211; l\u00e9galement fabriqu\u00e9s dans un \u00e9tat membre de l&#8217;Union europ\u00e9enne pour \u00eatre l\u00e9gitimement commercialis\u00e9es dans un autre pays membre UE sur le territoire fran\u00e7ais et\/ou sur autres territoires o\u00f9 le droit de propri\u00e9t\u00e9 intellectuelle et industrielle fran\u00e7ais est applicable, n&#8217;affecte pas le droit du titulaire d&#8217;une marque, dessin ou mod\u00e8le, car ce fait n\u2019implique pas aucune utilisation illicite du droit de protection. En effet, le transit intracommunautaire n&#8217;entre pas dans l\u2019objet sp\u00e9cifique du droit de propri\u00e9t\u00e9 industrielle et commerciale sur marques, dessins ou mod\u00e8les.<\/p>\n<h2><img decoding=\"async\" class=\"alignnone size-full wp-image-31966\" src=\"https:\/\/isam.it\/wp-content\/uploads\/gb.png\" alt=\"\" width=\"40\" height=\"20\" \/>\u00a0 <span style=\"color: #ed3201;\">BER<\/span><\/h2>\n<p><span style=\"color: #ed3201;\"><strong>ISAM PRODUCES MATCHING QUALITY SPARE PARTS ACCORDING TO THE DEFINITION CONTAINED UNDER COVER OF PARAGRAPH 20 OF THE GUIDELINES TO 461\/2010 EU REGULATION AS MODIFIED BY THE EUROPEAN COMMISSION RELATED TO 822\/2023 REG.<\/strong><\/span><\/p>\n<p>In the past the original spare part (in other words the spare directly produced by the vehicle\u2019s Home Manufacturer and\/or by their suppliers following to the standards and the technical specifications supplied them by the vehicle\u2019s Home Manufacturer itself, utilized for the production of the components to be fitted on the vehicles) has always been understood as a higher quality product if compared to the one produced by aftermarket manufacturers.<\/p>\n<p>Following to the coming into force of the UE Regulation 1400\/2002 (known as\u201d Monti\u2019s Law\u201d) relating to the application of the clause 81 paragraph 3 of the EU treaty (at present replaced by the clause 101, paragraph 3 of the operational treaty of the European Union) of bloc exemption to categories which operate in the automotive filed having vertical agreements and previously agreed practices. Thanks to the definition of clause 1, paragraph 1, point u, it has been introduced the concept of \u201cequivalent quality spare parts\u201d, on other words, spare parts manufactured by any manufacturer anytime able to certify that the quality of the above mentioned parts is fully correspondent to the one of the components utilized to be fitted on a brand new car.<\/p>\n<p>Then, due to the expiry of EU regulation 1400\/2002 on 31\/05\/2010, the European Commission has introduced a new legislative framework for the automotive field, focused on aftermarket matters.<\/p>\n<p>In force starting from 01\/06\/2010, these new standards are enclosed inside the bloc exemption EU Regulation 461\/2010 and the relating guidelines (sector- specific, about the vertical restrictions for the sale, the repair of the vehicles and the distribution of the spare parts) and inside the bloc exemption EU Regulation 330\/2010 and relating guidelines on vertical agreements, now replaced by 720\/2022 Regulation and relating guidelines.<\/p>\n<p>Under cover of paragraph 20 of the guidelines of EU regulation 1400\/2002 is specified the new definition of \u201cmatching quality spare\u201d whereby a part must have a quality level high enough to be able not to compromise the reputation of the producers of original parts authorized by the vehicle\u2019s Home Manufacturers.<\/p>\n<p>The EU Regulation 822\/2023 has extended the application of these rules up to 31\/05\/2028. The European Legislator has also introduced some modifications relating to the production and trade of spare parts as activity of repair and maintenance of cars, light duty vehicles and trucks. Among them, the car Home Manufacturer cannot deny to the licensed partners to use parts coming from another producer (review of paragraph 19 of guidelines to the standard of exemption for category 822\/2023).<\/p>\n<p>The Home manufacturer cannot deny to the licensed partners to utilize parts from other producers manufactured according to the specifications and standards of the first equipment ones. The same for the so called \u201cmatching quality spares\u201d that, as explained above, when utilized are able not to compromise the reputation authorized body repairer network (paragraph 20 of the guidelines)<\/p>\n<p>ISAM confirm that the parts produced and offered are \u201c<strong>matching quality spares<\/strong>\u201d according to paragraph 20 of the guidelines.<\/p>\n<p>The liability to prove that a part is not able to satisfy this condition is, always, at vehicle\u2019s Home Manufacturer charge.<\/p>\n<p>Therefore, view this new definition modifying the previous one specified under cover of the Monti\u2019s Law, a matching quality part cannot refer to the quality of the part fitted to the origin, even if it will be possible that this equivalent spare may have a quality better than the original one.<\/p>\n<h2><img decoding=\"async\" class=\"alignnone size-full wp-image-31965\" src=\"https:\/\/isam.it\/wp-content\/uploads\/fr.png\" alt=\"\" width=\"40\" height=\"20\" \/>\u00a0 <span style=\"color: #ed3201;\">BER<\/span><\/h2>\n<p><span style=\"color: #ed3201;\"><strong>ISAM PRODUIT DES PI\u00c8CES DE RECHANGE DE QUALIT\u00c9 \u00c9QUIVALENTE CONFORMEMENT \u00c0 LA D\u00c9FINITION CONTENUE AU PARAGRAPHE 20 DES LIGNES DIRECTRICES AU R\u00c8GLEMENT UE 461\/2010, TELLES QUE MODIFI\u00c9ES PAR LA COMMISSION EUROP\u00c9ENNE EN MARGE DU R\u00c8G. 822\/2023.<\/strong><\/span><\/p>\n<p>Dans le pass\u00e9, la pi\u00e8ce d&#8217;origine (c&#8217;est-\u00e0-dire la pi\u00e8ce de rechange produite directement par le constructeur du v\u00e9hicule et\/ou par ses fournisseurs conform\u00e9ment aux normes et aux sp\u00e9cifications techniques fournies par le constructeur du v\u00e9hicule, utilis\u00e9es pour la production des composants \u00e0 monter sur les v\u00e9hicules) a toujours \u00e9t\u00e9 consid\u00e9r\u00e9e comme un produit de qualit\u00e9 sup\u00e9rieure si compar\u00e9 \u00e0 celle produite par des fabricants de rechange \u00e9quivalents.<\/p>\n<p>Suite \u00e0 l&#8217;entr\u00e9e en vigueur du R\u00e8glement UE 1400\/2002 (\u00e9galement connu sous le nom de &#8221; Loi Monti &#8220;) concernant l&#8217;application de l\u2019article 81 paragraphe 3 du trait\u00e9 UE (maintenant remplac\u00e9e par l\u2019art. 101 paragraphe 3 du trait\u00e9 sur le fonctionnement de l\u2019Union Europ\u00e9enne) d&#8217;exemption en faveur d\u2019un accord de coop\u00e9ration ou pratiques convenues aux cat\u00e9gories qui op\u00e8rent dans le secteur automobile. Gr\u00e2ce \u00e0 la d\u00e9finition cit\u00e9e dans l\u2019art. 1, paragraphe 1, point u, il a \u00e9t\u00e9 introduit le concept de &#8220;pi\u00e8ces de rechange de qualit\u00e9 \u00e9quivalente&#8221;, c\u2019est-\u00e0-dire pi\u00e8ces de rechange produite par n&#8217;importe quel fabricant capable de certifier que la qualit\u00e9 de ces pi\u00e8ces correspond pleinement \u00e0 celle des composants utilis\u00e9s pour \u00eatre mont\u00e9s sur une nouvelle voiture.<\/p>\n<p>Ensuite, en raison de l&#8217;expiration du r\u00e8glement UE 1400\/2002 le 31\/05\/2010, \u00e0 partir du 01\/06\/2010, la Commission Europ\u00e9enne a introduit un nouveau cadre r\u00e9glementaire pour le secteur automobile, centr\u00e9 sur les th\u00e8mes du march\u00e9 de l&#8217;apr\u00e8s-vente.<\/p>\n<p>Ces nouvelles normes sont incluses dans le r\u00e8glement UE d&#8217;exemption par cat\u00e9gorie 461\/2010 et correspondantes lignes directrices (sp\u00e9cifiques dans le secteur des restrictions verticales des accords pour la vente et r\u00e9paration des v\u00e9hicules et la distribution des pi\u00e8ces d\u00e9tach\u00e9es) et dans le r\u00e8glement UE d&#8217;exemption par cat\u00e9gorie 330\/2010 et correspondantes directives sur les accords verticaux, maintenant remplac\u00e9 par le R\u00e8g. 720\/2022 et correspondantes lignes directrices.<\/p>\n<p>Le paragraphe 20 des lignes directrices au r\u00e8glement 461\/2010 contient une nouvelle d\u00e9finition de &#8220;pi\u00e8ces de rechange de qualit\u00e9 \u00e9quivalente&#8221; selon laquelle s\u2019agit de pi\u00e8ces d\u00e9tach\u00e9es avec un niveau de qualit\u00e9 suffisamment \u00e9lev\u00e9 pour ne pas compromettre la r\u00e9putation des producteurs autoris\u00e9s par les constructeurs automobiles.<\/p>\n<p>Le R\u00e8g. UE 822\/2023 \u00e9tend l\u2019application de ces normes jusqu\u2019au 31\/05\/2028, en introduisant \u00e9galement quelques modifications au sujet de production et vente de pi\u00e8ces de rechange et de l\u2019activit\u00e9 de r\u00e9paration et entretien de voitures, v\u00e9hicules utilitaires et poids lourds.<\/p>\n<p>Entre les autres, selon le nouveau paragraphe 19 des lignes directrices au R\u00e9g.
